Tailored Physique Terms of Service Effective Date: March 12, 2026

Welcome to Tailored Physique (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, personal training sessions, virtual training sessions, mobile training, fitness programming, and nutrition coaching services (collectively, the “Services”).

By accessing our website, purchasing, or participating in any Services, you agree to be bound by these Terms. If you do not agree, do not use our website or Services.

1. Eligibility

You must be at least 18 years old or have the consent of a parent or legal guardian. By using the Services, you represent and warrant that you are legally able to enter into this agreement.

2. Services Provided

Tailored Physique provides personal training, virtual training, mobile (in-person at client location) training, fitness programming, and nutrition coaching. Services may be delivered in person (mobile), online, or via video call depending on the package selected.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

3. Scheduling, Cancellations & Rescheduling

All sessions are scheduled as part of prepaid session packages.

  • Package Commitment & Early Cancellation: Packages are prepaid and represent a commitment to training. Once your first session is scheduled and/or completed, packages are non-cancellable and non-refundable except as expressly stated in these Terms or required by law. You may only cancel the entire package (with potential forfeiture of any used sessions) up to 24 hours before your second scheduled session. Any cancellation request after that point will not be accepted, and no refunds or credits will be issued for unused sessions.
  • Individual Session Cancellations/Rescheduling: Cancellations or reschedule requests for any individual session must be made at least 24 hours prior to the scheduled time. Late cancellations (less than 24 hours) or no-shows will result in the session being forfeited with no refund or credit.
  • Company-Initiated Cancellation: If Tailored Physique cancels or terminates your package for reasons other than your violation of these Terms (e.g., non-payment, unsafe behavior, or other discretionary reasons not due to client breach), we will provide a prorated refund for any unused, non-expired sessions based on the original per-session rate paid. Refunds will be processed within 30 days via the original payment method.
  • No-Shows: Failure to attend without notice results in a forfeited session with no refund or credit.

4. Payments & Refunds

  • All payments for session packages are due in advance and are non-refundable except as required by law or as provided in Section 3 above (Company-initiated cancellation).
  • Packages and individual sessions are non-transferable unless we agree in writing.
  • All purchased sessions expire two (2) years from the original date of purchase, regardless of usage. Expired sessions have no cash value and cannot be extended, reinstated, or refunded.
  • We may change pricing at any time; changes do not affect previously purchased packages.

5. Client Responsibilities

You agree to:

  • Provide accurate health, contact, and personal information.
  • Follow trainer instructions and exercise within your limits.
  • For mobile sessions, provide a safe training space and necessary equipment.

Failure to comply may result in suspension or termination of Services.

6. Intellectual Property

All content on our website and in Services (text, graphics, logos, videos, programs, workout plans) is owned by Tailored Physique and protected by copyright and other laws. You may not copy, reproduce, distribute, or create derivative works without written permission.

7. Termination

We reserve the right to refuse service, suspend, or terminate your access at our discretion, including for non-payment, unsafe behavior, or violation of these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, Tailored Physique, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Services or website. Our total liability shall not exceed the amount you paid for the Services giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Tailored Physique from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms. Continued use after posting changes constitutes acceptance.
